I really think you should start shaming companies publicly, Jack! Keep a list of hosts, billers, etc that harbor pirates.
It might be tough to switch hosts because of the technical hurdles involved, but people could avoid moving to such hosts. Out of principle, I’m sure a lot of people would avoid dealing with companies that deal with pirates, and that could have a SIGNIFICANT effect on the viability of stealing. Hopefully companies have more to lose by losing legitimate businesses than by losing pirates.
I’ll start: [SIZE=5]SegPay protects thieves and profits from them[/SIZE]. I have alerted them to a site that’s CLEARLY stealing content. Not only that, they don’t have 2257 records, so there could be CP on the site and SegPay doesn’t care at all. So anyone processing with SegPay is clearly at risk of losing their business any day.
They lied to me, saying they were terminating the account, but they haven’t. Clearly they’re asking to be sued, and they might just get their wish.
Out of principle, I will NOT send ANY traffic to any site that uses SegPay. Who’s with me?

SegPay is the worst when it comes to processing for sites like this. Aren’t they know part of Commerce Gate now?

We are actually having this debate internally and it’s a tough one. The law says that to comply with anti-piracy measures, you need to respond to DMCAs in a “reasonable” amount of time. So, are some of the web hosts, billers and tube sites that respond to DMCAs “reasonably” on the “good” side or the “bad” side? Certainly, ones who pro-actively work to make sure their systems aren’t being used for piracy are the “good” ones. MojoHost stood up to be counted in Phoenix on the right side of this issue. Tube sites that use the Vobile technology to actively screen uploads against a database of files are on the good side.
Just today I had a long conversation with some content producers who advertise on tube sites. Yes, the tubes respond to DMCAs (most at least), but I wouldn’t say that makes them “good.” But, as far as the law is concerned, they are actually doing all they need to do to combat piracy. Now, are they hiring someone internally (or externally) to pro-actively make sure there is no illegal content on their tubes? No, unless they are using Vobile. Manwin sites, for example, use the Vobile solution to try and stop piracy before content ever gets launched. That is the pro-active approach, but it’s not legally required (yet) to do so. Plus, the argument was that these other tube sites send good traffic and are doing their best by responding to DMCAs, so why not advertise on them.
I would say companies who actively court pirates or illegal content or put major roadblocks in our way to combat them should be on the blacklist.
If the blacklist included people who are not being pro-active and just towing the line as much as they are legally obligated to, the list would be huge and include almost everyone we all work with, sadly.
Web hosts in the Netherlands are particularly difficult, even though we are on seemingly good terms with them. But Dutch law is different from US law, and you can’t go to the hosting company until you’ve already gone to the site owner. Finding out who that site owner is often proves difficult or impossible and the hosting companies are more than happy to bury their heads in the sand while you try to figure that out. WebaZilla and LeaseWeb outwardly try to help, but have long been these kinds of safe harbors. Webazilla was even a main sponsor of XBIZ Vegas! They do respond to DMCAs, and doing the “minimum required by law” sadly puts them on the better side of the equation. But realize that MOST of the more egregious file hosts, torrents and pirate boards are hosted by these two companies.
Ask your billing company (yes, even the major ones we all use) what their stance on piracy is. And ask your web host, etc… as well. Their answers will surprise you because while they all tow the line legally, rarely do any of them go that extra step to be pro-active about it. I would LOVE for them all to be on a panel together so we could ask them this, or if they’d issue a policy statement on it. I think if the major billers were on the Piracy 401 (that MojoHost was on) you would have all been very surprised by what they had to say.
I think requesting that they all issue a policy statement on piracy would be a step in the right direction. Companies who refuse to be pro-active about piracy will then put themselves on the blacklist for us.

When it comes to SegPay, I just know from experience that I always see them used on dodgy sites that’s best avoided. It seems they have chosen to make money on the shady side of the web.

Well, Google and Yahoo! belong at the top of the list. While content may land on a tube site, G and Y create the largest avenues for spreading the word about links on tube and file share sites. Additionally, they have no issue hosting groups whose sole purpose is to illegally share links (and almost support their members with sharing links to content via email).

I think there is very little any takedown service can do in getting a forum closed other that issue notices to hosts etc.
This would require legally chasing the owners of the forum by the people who own the copyright. Anyone willing to do this?

I’ve contacted a Dutch attorney, and I’m certainly interested in doing what I can manage to at least get their hosting company to cooperate. It might be an uphill battle. BelAmiOnline, will anyone from your shop be at The Phoenix Forum?
