Not sure if you are aware or if you have tried this already.

DMCA notices are based on the US law and have no legal meaning in most other countries. The Dutch host is not required to respond to a DMCA notice. If they want they can throw away any request that is being called DMCA notice.

They have to act upon receipt of an “Notice and Takedown” though. While the notices are quite similar, what you call the document makes a difference here.

It sounds stupid, but this is how some hosts can call themselves “DMCA proof”,

I don’t believe that’s exactly correct. The Netherlands is a signatory to the Berne Convention which covers issues of copyright for all signatory countries, and the language of most notifications will make the claim under DMCA and Berne Convention rules… any lawyers here that can clarify?

As far as I know, the Berne Convention requires hosts to take action as per local copyright laws for copyright in any signatory country (if there are any), which means the Dutch Copyright Act is what counts in this case. The word DMCA simply doesn’t exist in the Dutch law.

ShaneAaron’s Dutch attorney should be able to shed some light on it.

I was able to get a website shut down in Germany after getting help from the German authorities. Within 36 hours, it was back up hosting in the Netherlands. Those fuckers just won’t die!
